Today’s reclassification assault on the Internet is the latest—and perhaps the most egregious—example.
In its effort to imposing crippling net neutrality regulations on the Internet—an idea with very little support from the American public or Congress—the Obama administration first turned to the FCC simply to pretend Congress has given it authority to regulate.
That effort suffered a major setback when the D.C. Circuit Court of Appeals emphatically smacked down the FCC’s regulatory proposals in Comcast v. FCC. President Obama and his close friend and FCC chairman Julius Genachowski, however, refuse to back down. Instead they’re escalating to the regulatory equivalent of a nuclear attack on the free-market Internet: Chairman Genachowski will announce today his intention to reclassify broadband Internet as an old-fashioned telephone system as a pretext for pervasive regulatory control.
Broadband Internet service has never been regulated like old-fashioned telephone lines — classified as “Title II” under the Telecommunications Act. The FCC settled the matter definitively in 1998, when Clinton-appointed FCC Chairman William Kennard demolished the same reclassification arguments being made today in that year’s Report to Congress:
Our findings in this regard are reinforced by the negative policy consequences of a conclusion that Internet access services should be classed as “telecommunications” … Classifying Internet access services as telecommunications services could have significant consequences for the global development of the Internet. We recognize the unique qualities of the Internet, and do not presume that legacy regulatory frameworks are appropriately applied to it.
If Chairman Genachowski announces, as expected, his intention to reclassify the Internet as a telephone system, he will be reversing 30 years of precedent starting with the Carter administration FCC’s “Computer II” decision and definitively settled with respect to broadband Internet access by the Clinton FCC in 1998. Turning sharply left from Carter and Clinton indicates a pretty extreme shift beyond the mainstream of American politics.
Such a shift is unjustified, because free-market Internet policy has been a tremendous success. The Internet — in the absence of regulation — has flourished into a remarkable engine of economic growth, innovation, competition, and free expression. Such triumph argues in favor of continuing existing successful policies, but with today’s announcement the FCC shows it is more interested in satisfying a left-wing political constituency than continuing sound policy.
Consider the words of one of the leading advocates of Internet regulation, Robert McChesney, founder of the left-wing group Free Press. McChesney said to SocialistProject.ca: “What we want to have in the U.S. and in every society is an Internet that is not private property, but a public utility.”
He went on to explain: “At the moment, the battle over network neutrality is not to completely eliminate the telephone and cable companies. We are not at that point yet. But the ultimate goal is to get rid of the media capitalists in the phone and cable companies and to divest them from control.”
Not surprisingly, Free Press put out a statement yesterday just minutes after the story leaked that the FCC would pursue reclassification. Remarkably, they openly stated that even the nuclear option of total regulatory control under a utility-type model is not enough for them, saying: “This is extremely welcome news. We reserve judgment, however, on whether the FCC has gone far enough.”
The communications industry is, like health care, roughly one-sixth of the U.S. economy. Unlike health care, however, the FCC seems to believe it can take over the communications system with just three votes at the Commission. If they insist on trying, Congress needs to step in and stop them.

You know this is a difficult decision to take sides on, due to the increased knowledge we have gained in the last 10 years, of the intent and ideology of some of the people employed or appointed or even elected, that now direct and manipulate former and new regulation and rules.
The example I give, is the obscenity and verbal communication rules under old (or current?) FCC telephone and ham radio etc communication, were good and enforced to a certain extent. Recent decisions by the Supremes allowing cartoons of kids or porno that is in the cartoon style as legitimate or legal, drives me crazy. Even the most astute and puter savey have not the ability to control all the obscene and disgusting porn getting through to kids, and even the public Libraries promote learning to beat the controls. So if FCC were content to regulate under former Constitutional or norm standards of telephone “speech”, I am sure many parents and religious orgs or family child protection agencies would be for it.
Unfortunately, we now know or many believe, that Free Speech and Court Decisions by revisionist and leftist ideologues have been used and are currently being used to actually infringe on religion, commerce and captalism amongst other things. Even the use of regulatory agencies like the Environmental Protection Department to implement law and control business and taxpayers when they can’t get something through Congress, is threatening free enterprise and private ownership rather than enforcing commonly shared values or law that was passed or is debated openly before Congress and the People. We have always been a nation of law and regulation that was for the common good, which many feel violence and pornography regulation encompassed. But the innovation of movies and TV slowly eroded common decency standards that originally held and were voluntarily followed by earlier companies. Most younger people say “so what” but older Americans know violence increased in direct proportion to more violence in the media and to younger and younger audiences.
All that aside, we used to “trust” FCC and Government to represent the public, and to use regulation in moderation. Under a different President and with a more independent Congress or one that represented the general public, this would be a possible way to regulate some of the terrible aspects of the internet and get it through the Courts. Sadly, it could also just be another way of manipulating free enterprise and Democracy or Republican form of Government, by giving control to unelected CZARS and the Supreme Leader (s) whoever they are. Do the Democrats allow this to happen on purpose? Do they all realize how much of their limited power they are just allowing the Executive Branch to steal from under their noses? Who has read all the legislation and regulation of FCC that controls the phone lines and can do a comparison of the good and bad that could come of this transfer or manipulation? It is not all bad and might have advantages as long as it didnt impinge on the entrapenuer and capitalistic spirit the net enjoys. Not all restriction is bad.
Its the President, the Congress and the board, even under Bush, that has been infiltrated by radical left idealogs that influences my trust in any current or future “controls” or “changes” this administration attempts, while denying any equal enforcement of existing law dealing with Poll Intimidation, Medicaid Fraud, Union corruption, Border Control or even State criminal and civil law meant to protect, etc. Non of their actions have shown a knowledge or desire to equally enforce law or to be constrained by law and regulation. Manipulation current law can be for the common good and help to curtail some of the harmful effects of Internet corruption through tried and true free speech regulation. But as pointed out, it could be another nail in the coffin of free speech and capitalism, through the back door and unsuspecting manipulation of FCC rules put in place when we were a more kind and gentle nation, with a firm concept of our shared values and ideology. Until then, I don’t trust anything this administration purposes. They just havent set an example of equal rights or equal opportunity. They seem more concerned with absolute power outcomes.
